Pagely Terms of Service

These Terms are the agreement between you and Blossomn — the small studio that builds Pagely — covering your use of the Pagely iPhone app, Pagely Pro subscriptions, and the Pagely website. By installing Pagely or signing into your Apple ID to download it, you accept these Terms.
01Who can use Pagely
Pagely is rated 12+ on the App Store. You need to be 13 or older to use it on your own account, and 18 or older to buy a Pagely Pro subscription. If you're a minor between 13 and 17, you can use Pagely under a Family Sharing organiser who is 18+.
Pagely is distributed exclusively through the Apple App Store. Your install also remains subject to Apple's Licensed Application End User License Agreement (EULA) — the standard EULA that ships with every App Store app — and Apple's Media Services Terms.
02Your iPhone, your data
Pagely is local-first. Your entries, attachments, and preferences live on your iPhone, and — if you turn on sync — in your own iCloud account. Blossomn does not run a Pagely server that holds your entries. We don't see what you write. See our Privacy Policy for the full picture.
You're responsible for keeping your iPhone secure and for backing up your data. We strongly recommend leaving iCloud sync on (or using Apple's local + iCloud iPhone backup) so that an entry doesn't vanish with a lost device.
03Plans, billing, and Apple as Merchant of Record
Pagely offers a perpetual Free tier and a paid Pagely Pro subscription with a 7-day trial. What's in each tier is listed on our pricing page; we reserve the right to adjust the free-tier feature list with notice.
Pagely Pro is sold through Apple's In-App Purchase. Apple Inc. is the merchant of record — Apple handles your payment, sales tax / GST / VAT, invoicing, and refund processing under Apple's Media Services Terms. Pagely Pro renews automatically (monthly or annually, as you chose) at the App Store price until you cancel.
Cancel any time from Settings → [your name] → Subscriptions on your iPhone. Cancellation stops the next renewal and you keep Pro features until the end of the current period.
Refunds are governed by Apple's refund policy and must be requested through reportaproblem.apple.com. Blossomn cannot issue Pro refunds because we never received your payment — Apple did. We can, however, help you file the request: email info@blossomn.com.
We may change Pro pricing with at least 30 days' notice via App Store Connect; existing subscribers will be notified per Apple's price-change rules and can decline the new price before renewal.
04Acceptable use
Pagely is a personal journal. You agree not to use it to:
- Reverse-engineer, decompile, or extract source from the app except where the law expressly allows it.
- Strip, alter, or hide our copyright, trademark, or attribution notices.
- Use any non-public Pagely API (the iCloud schema, internal endpoints) for purposes other than running your own copy of Pagely on your own device.
- Resell, sublicense, white-label, or redistribute Pagely or Pagely Pro entitlements to third parties.
- Use Pagely to record or store content that is unlawful where you live — child sexual abuse material, terrorist content, or anything else prohibited by applicable law. (Practically speaking we'd never see it; this is a no-purpose-of-doubt clause.)
05Apple's role
Because Pagely is sold and distributed through the App Store, the following App Store EULA clauses apply between you and us:
- You and Blossomn — not Apple — are the parties to these Terms. Apple is not responsible for Pagely or its contents.
- Your licence to use Pagely is limited to use on Apple-branded products you own or control, as permitted by the App Store Terms.
- Blossomn, not Apple, is solely responsible for Pagely and for any product warranties (to the extent any aren't disclaimed below) and for product or IP-infringement claims.
- Apple has no obligation to provide maintenance or support for Pagely — email info@blossomn.com for that.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
06iCloud sync
Pagely's sync uses Apple's CloudKit private database under your Apple ID. We don't operate a server that holds your entries. If iCloud is unavailable, full, or you've signed out — sync will pause. Disabling sync from Pagely → Settings → iCloud removes your data from CloudKit; your local copy on the device is untouched.
07Your content stays yours
Journal entries, attached photos, voice notes, and any custom prompts you add are yours. Pagely's local storage and iCloud sync are technical means by which we help you keep them. We claim no licence over your entries, don't sell them, and don't train AI models on them. We can't — we don't see them.
08Our intellectual property
The Pagely name, wordmark, app icon, prompt catalogue, screen designs, and source code are owned by Blossomn. These Terms grant you a personal, non-exclusive, non-transferable licence to use Pagely on Apple devices you own — nothing more. Ask first if you want to mention Pagely in a case study or screenshot it for an article. We usually say yes.
09Updates and changes to the app
We ship Pagely updates through the App Store. Some updates add features; some fix bugs; some adapt to new iOS APIs or App Store policies. We may add, change, or remove features over time. If a removal would meaningfully reduce a feature you paid Pro for, we'll surface a notice in-app at least 14 days in advance where possible.
We support the current and previous major iOS versions. Older devices may continue to run an existing copy of Pagely indefinitely, but won't receive new features.
10Service availability
Pagely is an on-device app — it works without a Pagely server. iCloud sync depends on Apple. The marketing site, App Store, and Apple's services have their own availability characteristics outside our control. We don't offer a contractual SLA.
11Warranties — disclaimer
Pagely is provided "as is" and "as available". To the maximum extent allowed by Indian law and the App Store EULA, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or perfectly secure, and we don't warrant that iCloud sync will be uninterrupted (that's Apple's infrastructure).
12Limitation of liability
To the fullest extent permitted by law, Blossomn is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including lost data, lost entries, lost photos, business interruption, or emotional distress — arising from your use of Pagely, even if we were warned of the possibility.
Our total aggregate liability for any claim relating to Pagely is capped at the greater of (a) the amount you actually paid for Pagely Pro in the 12 months before the claim arose, or (b) ₹2,000.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g., for fraud, or for death or injury caused by negligence).
13Indemnity
You agree to defend and indemnify Blossomn (and, per the App Store EULA, Apple) against third-party claims arising from (i) your misuse of Pagely, (ii) content you create that infringes someone else's rights, or (iii) your breach of these Terms.
14Termination
You can stop using Pagely at any time — delete the app, cancel Pagely Pro from Settings → Subscriptions. We may suspend or terminate access if you breach these Terms or if continuing to serve you would expose us or Apple to legal or security risk. Because your entries are on your device and in your iCloud, terminating your relationship with us does not require us to delete entries; you delete them yourself.
Sections that should reasonably survive termination — IP, disclaimers, liability, indemnity, governing law — will survive.
15Changes to these Terms
We may update these Terms occasionally. Material changes will be surfaced in-app at least 14 days before they take effect, with a "Last updated" stamp here. Continued use after the effective date means you accept the updated Terms; if you don't want to, please delete Pagely before then.
16Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute, subject to your non-waivable consumer-protection rights in your country of residence and Apple's parallel terms under the App Store EULA.
Before filing anything, please email us — most things sort themselves out in a couple of emails, and we'd rather solve a problem than litigate one.
17Miscellaneous
If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a right isn't a waiver of it. You can't assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of the Blossomn business.
