DriftSleep Terms of Service

These Terms are the agreement between you and Blossomn — the small studio that builds DriftSleep — covering your use of the DriftSleep iPhone app, DriftSleep Pro subscriptions, and the DriftSleep website. By installing DriftSleep or signing into your Apple ID to download it, you accept these Terms.

01Who can use DriftSleep

DriftSleep is rated 4+ on the App Store. You need to be 13 or older to use it on your own account, and 18 or older to buy a DriftSleep Pro subscription. If you're a minor between 13 and 17, you can use DriftSleep under a Family Sharing organiser who is 18+.

DriftSleep is distributed exclusively through the Apple App Store. Your install also remains subject to Apple's Licensed Application End User License Agreement (EULA) — the standard EULA that ships with every App Store app — and Apple's Media Services Terms.

02Not a medical device

DriftSleep is a consumer wellness app. It is not a medical device. It does not diagnose, treat, cure, or prevent any disease — including sleep apnea, insomnia, snoring disorders, or any other sleep-related condition. The sleep score, snore timeline, stage estimates, and coaching tips are informational only and are derived from consumer-grade sensors. Do not use DriftSleep to make medical decisions. If you have a sleep concern, please speak to a qualified clinician.

03Your iPhone, your data

DriftSleep is local-first. Your sessions, snore metadata, and preferences live on your iPhone, and — if you turn on sync — in your own iCloud account. Blossomn does not run a DriftSleep server that holds your sleep data. We don't see what you slept like. See our Privacy Policy for the full picture.

You're responsible for keeping your iPhone secure and for backing up your data. We strongly recommend leaving iCloud sync on (or using Apple's local + iCloud iPhone backup) so that a session doesn't vanish with a lost device.

04Microphone, alarm, and notifications

DriftSleep needs a few iOS permissions to work properly:

For DriftSleep to reliably wake you, your phone must be charging, awake-capable, and unmuted at alarm time — or critical-alarm permission must be granted. We can't override iOS-level Focus modes, Low Power Mode behaviors, or hardware faults; please don't rely on DriftSleep as your only alarm for safety-critical wake-ups.

05Plans, billing, and Apple as Merchant of Record

DriftSleep offers a perpetual Free tier and a paid DriftSleep Pro subscription with a 7-day trial. What's in each tier is listed on our pricing page; we reserve the right to adjust the free-tier feature list with notice.

DriftSleep Pro is sold through Apple's In-App Purchase. Apple Inc. is the merchant of record — Apple handles your payment, sales tax / GST / VAT, invoicing, and refund processing under Apple's Media Services Terms. DriftSleep Pro renews automatically (monthly or annually, as you chose) at the App Store price until you cancel.

Cancel any time from Settings → [your name] → Subscriptions on your iPhone. Cancellation stops the next renewal and you keep Pro features until the end of the current period.

Refunds are governed by Apple's refund policy and must be requested through reportaproblem.apple.com. Blossomn cannot issue Pro refunds because we never received your payment — Apple did. We can, however, help you file the request: email info@blossomn.com.

We may change Pro pricing with at least 30 days' notice via App Store Connect; existing subscribers will be notified per Apple's price-change rules and can decline the new price before renewal.

Because DriftSleep is sold and distributed through the App Store, the following App Store EULA clauses apply between you and us:

08iCloud sync

DriftSleep's sync uses Apple's CloudKit private database under your Apple ID. We don't operate a server that holds your sessions. If iCloud is unavailable, full, or you've signed out — sync will pause. Disabling sync from DriftSleep → Settings → iCloud removes your data from CloudKit; your local copy on the device is untouched.

09Your content stays yours

Your sleep sessions, snore metadata, and any notes you add are yours. DriftSleep's local storage and iCloud sync are technical means by which we help you keep them. We claim no licence over your sleep data, don't sell it, and don't train AI models on it. We can't — we don't see it.

10Our intellectual property

The DriftSleep name, wordmark, app icon, illustration set, on-device snore classifier, screen designs, and source code are owned by Blossomn. These Terms grant you a personal, non-exclusive, non-transferable licence to use DriftSleep on Apple devices you own — nothing more. Ask first if you want to mention DriftSleep in a case study or screenshot it for an article. We usually say yes.

11Updates and changes to the app

We ship DriftSleep updates through the App Store. Some updates add features; some fix bugs; some adapt to new iOS APIs, HealthKit changes, or App Store policies. We may add, change, or remove features over time. If a removal would meaningfully reduce a feature you paid Pro for, we'll surface a notice in-app at least 14 days in advance where possible.

We support the current and previous major iOS versions. Older devices may continue to run an existing copy of DriftSleep indefinitely, but won't receive new features.

12Service availability

DriftSleep is an on-device app — it works without a DriftSleep server. iCloud sync depends on Apple. The marketing site, App Store, and Apple's services have their own availability characteristics outside our control. We don't offer a contractual SLA.

13Warranties — disclaimer

DriftSleep is provided "as is" and "as available". To the maximum extent allowed by Indian law and the App Store EULA, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, fitness as a medical or diagnostic tool, fitness as a primary alarm clock, and non-infringement. We don't warrant that the app will be uninterrupted, error-free, or perfectly secure, that the alarm will always fire, or that snore detection will catch every episode, and we don't warrant that iCloud sync will be uninterrupted (that's Apple's infrastructure).

14Limitation of liability

To the fullest extent permitted by law, Blossomn is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages — including lost data, lost sessions, missed alarms, missed obligations resulting from a missed alarm, business interruption, or any health outcome — arising from your use of DriftSleep, even if we were warned of the possibility.

Our total aggregate liability for any claim relating to DriftSleep is capped at the greater of (a) the amount you actually paid for DriftSleep Pro in the 12 months before the claim arose, or (b) ₹2,000.

Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g., for fraud, or for death or injury caused by negligence).

15Indemnity

You agree to defend and indemnify Blossomn (and, per the App Store EULA, Apple) against third-party claims arising from (i) your misuse of DriftSleep, (ii) using DriftSleep to record or analyze another person without their consent, or (iii) your breach of these Terms.

16Termination

You can stop using DriftSleep at any time — delete the app, cancel DriftSleep Pro from Settings → Subscriptions. We may suspend or terminate access if you breach these Terms or if continuing to serve you would expose us or Apple to legal or security risk. Because your sessions are on your device and in your iCloud, terminating your relationship with us does not require us to delete sessions; you delete them yourself.

Sections that should reasonably survive termination — IP, disclaimers, liability, indemnity, governing law — will survive.

17Changes to these Terms

We may update these Terms occasionally. Material changes will be surfaced in-app at least 14 days before they take effect, with a "Last updated" stamp here. Continued use after the effective date means you accept the updated Terms; if you don't want to, please delete DriftSleep before then.

18Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. The courts of Bengaluru, Karnataka have exclusive jurisdiction over any dispute, subject to your non-waivable consumer-protection rights in your country of residence and Apple's parallel terms under the App Store EULA.

Before filing anything, please email us — most things sort themselves out in a couple of emails, and we'd rather solve a problem than litigate one.

19Miscellaneous

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a right isn't a waiver of it. You can't assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of the Blossomn business.
